Abstract

Administration of Estate broadly speaking belongs to that branch of law commonly called Law of Succession, but strictly speaking it deals with the administration of a deceased person's interests in real and personal properties. A person may die testate or intestate; whereas the succession to property of a person who dies testate is largely settled, where a person dies intestate, there are a series of problems. Such problems include choosing the appropriate person to succeed to the deceased's property, the rules to be applied in distributing his estate among his dependants, sometimes it may even be in respect of the quantity, nature and extent of the estate of the deceased. In this case under review, all these were not the issue, the dispute is more of an issue of law than of facts which make it quite interesting.
