Abstract

Land may be acquired as family land, allotted by the state, bought from a family or allottee, or by inheritance. Every conveyance¹ legally should be prepared and pursued by a solicitor.² A solicitor is trained in negotiating, preparing and the perfection of instruments and as a professional among other duties, he owes a duty of care to his client and third parties. A very important stage in conveyancing is the investigation of the title of the vendor in respect of the property to be purchased. As a general rule the principle here is caveat emptor hence where title is not properly investigated it may lead to the purchase of defective title.
