Abstract

INTRODUCTION
We are concerned here with a Court Martial. Who can convene a General Court Martial? Can such a power be delegated? Theses two questions were answered by the Supreme Court in the recent case of N.A.F. v. James.1 The purpose of this review is to examine the basis of the Supreme Court decision vis-à-vis, the decision of the Court of Appeal and the provisions of the Law. This is particularly important as a number of similar appeals are presently in the Court of Appeal and Supreme Court²
