Abstract

Generative artificial intelligence (GenAI) is reshaping the time, labour and cost structure of legal services. For Nigerian legal practitioners, the central ethical and regulatory question is how professional fees should be calculated, disclosed, and justified when automation compresses work previously performed over several hours or days. The problem operates in two directions: fictitious time entries may convert efficiency into overcharging, while AI-enabled price competition may encourage practitioners to undercut mandatory minimum scales under the Legal Practitioners Remuneration Order 2023. This article adopts a doctrinal and functional comparative method. It examines the Rules of Professional Conduct for Legal Practitioners 2023, the Remuneration Order 2023, the Legal Practitioners Act and the Nigeria Data Protection Act 2023, alongside selected guidance from the United States and England and Wales. It argues that GenAI does not automatically render an agreed, fixed or prescribed fee unreasonable because professional value also reflects expertise, complexity, responsibility, risk and client benefit. Nevertheless, fictitious billing, concealed technology charges, misleading accounts of human input and charging clients to correct avoidable AI-generated errors are professionally indefensible. The article proposes the FAIR-AI framework, comprising a legally compliant fee basis, accurate time recording, material disclosure, reasonable technology charges, non-delegable lawyer accountability and independent verification. It also recommends a billing matrix, a model engagement clause, professional training and a proposed rule 52A. The framework offers a practical basis for reconciling innovation and sustainable professional income with statutory price floors, client protection and transparent legal practice.
